ICFC Digital LMS Terms and Conditions

ICFC Pte Ltd, UEN 201402439E

ICFC Pte Ltd, UEN 201402439E. Singapore. Draft for legal review before publication.

1. About these terms

These terms apply to courses booked or accessed through the ICFC Digital learning platform at icfc.digital (the LMS) and to classroom courses booked through it, provided by ICFC Pte Ltd (UEN 201402439E). By creating an account or booking a course, you agree to these terms. Company bookings bind the company and its learners.

2. Definitions

Learner means the person attending a course. Client means the person or company that books and pays. Course means any classroom, live-online or self-paced programme. Course page means the page in the LMS that describes a course, its fee, schedule, mode and any funding status.

3. Accounts

Learners must give accurate information and keep login details private. Accounts are personal and may not be shared. LMS learner accounts are separate from ICFC staff systems. We may suspend accounts that are misused.

4. Bookings, prices and payment

A booking is confirmed when we send a confirmation and payment, or an accepted purchase order, is received by [x] days before the start date. Course pages show the full fee in Singapore dollars, including every mandatory charge; we do not add charges at checkout that were not shown upfront, and optional extras are never pre-selected. At the date of these terms ICFC is not registered for GST, so no GST is charged; if this changes, prices shown to individuals will include GST. Any discount is shown with its conditions and end date and is calculated from a price we genuinely charge.

5. Funding and grants

Funding is available only for courses whose course page states that they are approved for a named scheme, and funded fees are shown only with the eligibility conditions. Eligibility is decided by the funding agency, not ICFC. The client is responsible for meeting eligibility conditions, including attendance and assessment requirements. If funding is rejected, reduced or recovered because a condition was not met, the client pays the difference. We do not offer cash, gifts or rebates linked to the use of funding.

6. Cancellation by the client

Notice in writing is required. Refunds of fees paid are: [x]% if cancelled [x] or more working days before the start date; [x]% if cancelled between [x] and [x] working days before; no refund if cancelled less than [x] working days before or after the course starts. Self-paced courses are not refundable once accessed, unless the law requires otherwise.

7. Transfers and replacements

A learner may transfer once to another run of the same course if we receive written notice [x] working days before the start date, subject to seats and any admin fee of S$[x]. A replacement learner from the same company may attend at no extra charge if named before the start date, subject to funding rules.

8. No-show

A learner who does not attend without notice is treated as a late cancellation and the full fee is payable. Funding cannot be claimed for absent learners.

9. Changes by ICFC

We may change trainers, venues or the delivery mode, or reschedule or cancel a course, for example when enrolment is too low or for reasons beyond our control. If we cancel, you may transfer to another run or receive a full refund of fees paid. We are not responsible for travel or other costs.

10. Attendance and assessment

Learners must attend at least [x]% of classroom or live-online sessions and complete required activities to receive a certificate of completion. Where a course has an assessment, learners who do not pass may resit [x] time(s) within [x] months for a fee of S$[x] per resit.

11. Certificates

Certificates of completion are issued electronically within [x] working days after all requirements are met. A certificate of completion confirms attendance and, where stated, assessment results. It is not a certification of an organisation or a professional licence unless the course page says so.

12. Online access

Self-paced courses can be accessed for [x] days from enrolment. Learners need a supported browser and a stable internet connection; requirements are on the course page. Planned maintenance is announced where possible.

13. Conduct

Learners must behave respectfully, follow trainer instructions and not share assessment answers. Recording sessions, sharing course materials or giving others access is not allowed. Breaches may lead to removal without refund.

14. Intellectual property

Course materials belong to ICFC or its licensors. Learners receive a personal, non-transferable licence to use them for their own learning. Standards documents are copyright of their publishers and are not supplied unless the course page says so.

15. Privacy

We handle personal data under our Privacy Policy. Records needed for funding claims or certificates are kept as long as the relevant agency or law requires.

16. Liability

Courses provide education and do not guarantee certification, audit outcomes or funding approval. To the extent the law allows, our total liability for any course is limited to the fee paid for it, and we are not liable for indirect or consequential loss. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited under Singapore law, including the Unfair Contract Terms Act.

17. Events beyond our control

We are not responsible for delay or failure caused by events beyond our reasonable control, such as outages, public health measures or natural events. We will offer a reasonable alternative where we can.

18. Feedback and complaints

Feedback and complaints can be sent to admin@icfc.com.sg. We acknowledge them within [x] working days and aim to resolve them within [x] working days, with a review by a manager who was not involved. Individual consumers may also contact the Consumers Association of Singapore (CASE), and may have rights under the Consumer Protection (Fair Trading) Act.

18A. Marketing

Booking a course does not sign you up for marketing. We send marketing only on the channels you opt in to, as described in our Privacy Policy.

19. Changes to these terms

We may update these terms. The version in force when you book applies to that booking.

20. Governing law

These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction.
